These Terms & Conditions govern your booking with Hermes Tour Limited (“Hermes Tour”, “we”, “us” or “our”), a tour operator and travel designer registered in London, United Kingdom. Please read them carefully; by making a booking you confirm that you have the authority to accept and do accept these Terms on behalf of all members of your party.

About These Terms

These Terms apply to all travel arrangements designed and sold by Hermes Tour, whether as a tailor-made itinerary or a single component. They form the basis of your contract with us. Where we act solely as a booking agent for an independent supplier, that supplier’s own terms will also apply and we will make this clear at the time of booking.

Booking and Your Contract

A contract between us comes into existence when we issue our written confirmation invoice after receiving your deposit. Please check all details on your confirmation carefully and tell us immediately of any errors, as it may not be possible to make changes later. We reserve the right to decline any booking at our discretion.

Payment

A deposit, the amount of which will be advised at the time of booking, is required to confirm your arrangements. The balance is due no later than the date shown on your confirmation invoice, typically ten weeks before departure. For bookings made within that period, full payment is required at the time of booking. If the balance is not received by the due date we reserve the right to treat the booking as cancelled by you.

Prices and Surcharges

Prices are confirmed at the time of booking. Once your contract is in place, we will not increase the price except to reflect genuine changes in transport costs, taxes, fees or exchange rates, and never within twenty days of departure. Where any such surcharge would exceed the limits permitted by law, you may cancel and receive a full refund of monies paid, subject to applicable regulations.

Changes and Transfers by You

If you wish to amend your arrangements after confirmation, we will do our best to accommodate you. An administration fee may apply, together with any additional costs charged by our suppliers. Certain elements, such as flights, may be non-changeable once issued.

Cancellation by You

Cancellations must be notified to us in writing. As we incur costs from the moment your booking is confirmed, cancellation charges apply on a sliding scale according to how far before departure we receive your notice, up to one hundred per cent of the total cost. We strongly recommend comprehensive travel insurance to protect against cancellation charges.

Changes or Cancellation by Us

Occasionally we may need to make changes to your arrangements, and we reserve the right to do so. Most changes are minor; where a significant change becomes necessary we will inform you as soon as possible and offer you the choice of accepting the change, taking an alternative journey, or cancelling for a full refund. We will not cancel your travel less than a defined period before departure except for reasons of force majeure or your failure to pay.

Travel Insurance

Adequate travel insurance is a condition of travelling with Hermes Tour. Your policy should cover, as a minimum, medical expenses, repatriation, cancellation and curtailment. Please ensure your cover is appropriate for the destinations and activities included in your journey.

Passports, Visas and Health

It is your responsibility to hold a valid passport and to obtain any visas, permits and vaccinations required for your journey. We are happy to offer general guidance, but requirements vary and can change; you should verify them with the relevant embassy or a qualified medical professional. We accept no liability where you are refused entry or travel as a result of incomplete documentation.

Your Responsibilities

You agree to behave in a manner that does not cause distress, danger or damage to others or to property, and to comply with the reasonable instructions of our suppliers. We may terminate arrangements for any guest whose conduct is unacceptable, without liability or refund.

Our Liability

We accept responsibility for arranging your travel with reasonable skill and care. We will accept liability for the acts or omissions of our employees and suppliers as set out in applicable law and subject to the limits of relevant international conventions. We are not liable for events that could not have been foreseen or avoided, or that amount to force majeure.

Financial Protection

Your money is protected. Flight-inclusive holidays are financially protected by the ATOL scheme; we will provide an ATOL Certificate when you book. Where your arrangements do not include flights, protection is provided through our ABTA membership. These arrangements mean that, in the unlikely event of our insolvency, your booking and any monies paid are safeguarded.

Complaints

If a problem arises during your journey, please tell our local representative or supplier at once so it can be resolved promptly. If matters cannot be settled at the time, please contact us in writing within twenty-eight days of your return so we can investigate fully.

Governing Law

These Terms and any dispute arising from them are governed by the laws of England and Wales, and you agree to submit to the exclusive jurisdiction of the courts of England and Wales, unless otherwise required by applicable law.
